The Public Gambling Act, 1867 — what it actually says

India's foundational gambling law is more than 150 years old. It was drafted by the British to clamp down on physical gambling dens. Two things matter for today:

  • The Act criminalises running or visiting a "common gaming house" — a brick-and-mortar venue.
  • Section 12 explicitly exempts games of mere skill wherever they are played.
  • The word "internet", "online" or "website" does not appear anywhere in the Act.

Because the Constitution of India (Entry 34, List II) puts "betting and gambling" on the State List, every state can write its own law on top of the 1867 Act — and most have.

Skill vs chance — the test every Indian court uses

Indian jurisprudence draws a hard line between games of skill and games of chance. The Supreme Court reaffirmed this in State of AP v. K. Satyanarayana (1968) for rummy and Dr. K.R. Lakshmanan v. State of Tamil Nadu (1996) for horse racing. In 2021 the Bombay, Rajasthan and Punjab & Haryana High Courts extended the same protection to fantasy sports operators.

Cricket betting on an exchange is treated as wagering on a game of skill in most states, because users price live probabilities rather than spinning a wheel. Pure chance products — roulette, slot machines, lottery wheels — fall outside this protection and are regulated more tightly.

Taxes on betting winnings — 30% TDS rule explained

  • Section 115BB taxes winnings at a flat 30% plus applicable surcharge and 4% cess — no deductions, no slab benefit.
  • Section 194BA (effective 1 April 2023) requires the platform to deduct 30% TDS on net winnings at the time of withdrawal.
  • Withdrawals above ₹100 per transaction are reported to the Income Tax Department.
  • You must declare winnings under "Income from Other Sources" in your ITR even if TDS was already deducted.

FEMA, UPI and offshore exchanges

The Foreign Exchange Management Act (FEMA) prohibits outward remittances for gambling purposes. This is why Indian users almost never deposit directly from an Indian bank to an offshore exchange.
